Use of our website and services

You must be 18 years or over to use our website or any of our services. The primary purpose of our website is to enable the listing of property for sale on a fractional shared ownership basis and constructed either in the UK or overseas. Although we make every effort to ensure the accuracy of any information provided we cannot accept legal responsibility should any errors occur? If you intend to act on any information on our site, you must make appropriate enquiries before proceeding as to its accuracy and suitability for your purposes and you must also take appropriate advice.

The buying process

Purchasers will be provided with marketing literature outlying the various fractional ownerships available through us. If you decide to purchase your initial step is to place a reservation by completing the official reservation form and paying the appropriate reservation fee. You will also be required to pay a setup/arrangement fee within 14 days of the reservation date. This fee is to pay for the formation of the limited company and associated documentation and administration costs. We strongly advise you to conduct your own independent evaluation to confirm any details on which you have relied upon to make your decision to buy in to a fractional ownership scheme. When you have completed your appraisal and wish to proceed you will need to sign and return the appropriate legal documentation. The completion of the transaction will take place at such time when the property has been physically completed and fully furnished.

Payments

All our fees shown do not include VAT unless otherwise stated. All payments should be by Credit/Debit cards. We will only consider a payment by cheque by prior arrangement.

Refunds

The reservation fee is non-refundable. The sole exception to this is if the scheme in which you have entered into is unable to proceed to completion due to actions of any third party, excluding the purchaser, (ie: the developer goes in to liquidation) and in this instance the fee will be refunded to the purchaser in full. The setup/arrangement fee will be fully refunded if the purchasers decide not to proceed within 28 days of the date of reservation. If the purchasers cancels the reservation after the 28 day period then they will be entitled to receive 50% of the setup/arrangement fee only. Cancellations made 56 days after the date of reservation will not be entitled to any refund.

Intellectual property rights

All trade marks, logos, graphics, images, photographs, animation, videos, text and software used on the site and the services are the intellectual property of us or our partners. You may retrieve, display, download, copy or print such content insofar as necessary for legitimate purposes in connection with our products and services advertised on this site. You may not otherwise retrieve, display, modify, copy, print, sell, download, hire or reverse engineer (unless permitted by applicable law) such content without our prior written consent. If you copy any content as permitted above, you must ensure that our copyright notice on the relevant page is included. If you publish any content on our site, you grant us a worldwide, perpetual, non-exclusive, royalty-free licence to copy, alter, adapt, translate, display, sublicense, assign and create derivative works from that content in any media. You waive your moral rights in relation to such content.

Law and jurisdiction

This contract shall be governed by English law and any disputes will be decided only by the English courts.
